What is Mediation?
Mediation is a voluntary process, where both parties themselves commit to the process of mediation. The mediator acts as the facilitating third party during mediation and is trained to be completely unbiased and impartial.

Mediation opens communication channels and allows parties to come to an agreement that would not otherwise have been possible through litigation.

During Mediation the parties are in control of the outcome and decisions and this is a more positive way to handle divorce and family disputes as you need to restore and keep a healthy relationship with the other party involved. This needs to continue after the dispute has been resolved.

Empowerment

Mediation is an empowering process where all parties involved takes back the control into their own hands to come to a workable and reasonable agreement which is suitable and acceptable to both parties. This is done in an environment which is safe and filled with less anxiety and fear.

Process

The process will provide each party the opportunity to state their fears, concerns, needs, dissatisfaction and wishes.

Divorce Mediation

Mediation is able to provide a private, non-adversarial, reverent platform for divorcing parties to settle all aspects of their divorce dispute including division of property, financial consequences and arrangements regarding children.

Child Support

All parents, whether they’re married to each other or not, must support their children financially. Every state has its own child support guidelines; these are the starting point for every decision about who will pay child support and how much. In general, the primary factors the court will consider are how much each parent earns and how much time each parent spends with the children. Other factors can come into play, too, including whether either parent has the ability to earn more, whether the child has special needs, and which parent pays for child care and health insurance. Support can last until the child is 18 or even longer, depending on where the parents and child live and on the child’s needs.

In an appeal, you ask the appeal court to set aside a decision made by a Federal Circuit and Family Court of Australia judge. An appeal is not a rehearing of the original dispute. Therefore, for your appeal to succeed you must convince the appeal court that the original judge (known as the primary judge or the trial judge) made an error.
